We have considerable experience in assisting family members of recipients of personal injury awards to obtain a clearance from HMRC to allow them to receive payment for providing family care without deduction of tax and national insurance.
Obtaining such a clearance can assist the family member to claim for the Carer’s Allowance (subject to meeting the qualifying conditions) and also to qualify for Tax Credits (again subject to meeting the qualifying conditions).

Obtaining such a clearance may help to preserve the personal injury funds as there is no liability to employer’s national insurance contributions. Normally we will discuss options regarding the carer obtaining national insurance credits or making voluntary contributions as appropriate.
